Privacy notice
This notice is provided by SMAX Otomotiv as data controller under Article 10 of the Turkish Personal Data Protection Law No. 6698 (“KVKK”), to explain how personal data is processed through smaxotomotiv.com and our communication channels.
1. Personal data we process
- Identity and contact: name, phone number, email address, company name you share with us.
- Request details: product codes, OEM numbers, quantities, photos and message content you send.
- Technical data: IP address, browser information and request times recorded by our hosting provider for security.
2. How and why we collect it
Data is collected electronically when you contact us by WhatsApp, phone or email, or when you fill in the contact form and send the prepared message on WhatsApp. The contact form and quote list do not store anything on our servers. Data is processed to answer your product, price and stock questions, prepare quotes, communicate with you and keep the website secure, based on KVKK Article 5/2-(c) (necessary for establishing a contract), 5/2-(ç) (legal obligations) and 5/2-(f) (our legitimate interest in operating a secure website).
3. Transfers
Personal data may be shared with authorised public bodies where required by law. The website is hosted by Cloudflare, Inc., whose servers are located in several countries, and WhatsApp messages are processed on the infrastructure of WhatsApp/Meta; these transfers abroad are carried out in accordance with Article 9 of the KVKK. We do not sell your data or use it for advertising.
4. Retention
Data is kept for as long as needed to handle your request and for the periods required by applicable law, then deleted or anonymised.
5. Cookies and browser storage
The website does not use advertising or tracking cookies. Your quote list and its note are stored only in your own browser (local storage) and are not sent to us until you send them on WhatsApp.
6. Your rights
Under Article 11 of the KVKK you may: learn whether your data is processed and request information about it; learn the purpose of processing and whether it is used accordingly; know the third parties it is transferred to in Türkiye or abroad; request correction of incomplete or inaccurate data; request deletion or destruction under Article 7; request that correction or deletion be notified to third parties; object to a result against you arising exclusively from automated analysis; and claim compensation for damages arising from unlawful processing.
7. How to apply
You can send your request in writing by email to Smax_Otomotiv@outlook.com, in accordance with the Communiqué on the Procedures and Principles of Application to the Data Controller. We will answer free of charge within 30 days at the latest.
